Introduction of SB 53

California Governor Gavin Newsom has signed Senate Bill 53, known as the "Transparency in Frontier Artificial Intelligence Act," into law. This legislation introduces new safety reporting requirements for large AI companies operating in California.

Revised Approach

SB 53 is a revised version of the previously vetoed SB 1047. The original bill was deemed too strict and potentially harmful to AI innovation. Following the veto, Governor Newsom tasked AI researchers with developing an alternative, leading to the creation of SB 53.

Safety Reporting Requirements

The new law mandates that large AI companies, particularly those with training costs exceeding $100 million, publish their safety protocols and updates within 30 days. This requirement aims to enhance transparency and accountability in AI development.

Voluntary Frameworks and Enforcement

While SB 53 enhances transparency, it does not mandate third-party evaluations. Instead, it may rely on voluntary frameworks, which have faced criticism for limited enforceability. The law introduces mechanisms for reporting safety incidents and allows the California Department of Technology to suggest annual updates in response to technological and global developments.

The enactment of SB 53 has garnered mixed reactions from the tech industry. Some companies, like Anthropic, have expressed support for the law, while others, including Meta and OpenAI, have raised concerns. These companies favor federal or international regulations over state-specific mandates.
